This sales contract is made between Jason A Prescott of Beau Joli Pomeranians-party of the first part-termed the seller and the party of the second part-termed the buyer whose name address and telephone number appear at the bottom of this contract and does hereby obligate the buyer and seller to the terms of this contract when signed by both parties. The seller agrees to sell, and does hereby sell, and has contracted to the buyer a dog of Pomeranian breed: (Description regarding such dog at top of contract) in sound body and good health, and free from communicable disease as far as appears to the eye. A 72 hr. warranty against distemper, hepatitis, adenovirus 2, parvovirus, and coronavirus applies to this dog. A one year warranty against congenital defects limited to the eyes, heart, liver, and lungs (applies to a puppy under the age of 12 mos. only). All pet puppies sold with Limited AKC registration must be spayed or neutered-without exception. Pet puppies are not under the same warranty provisions as show puppies as there are no guarantees as to exact adult weight or color. AKC registration papers will not be given until terms of contract are fulfilled by buyer. If the buyer elects to keep the dog with a warranted defect-then seller will credit buyer the amount paid for this dog over and above the base price for a PET of their color category toward any future purchase of another dog at any time. If the dog is returned, a replacement dog of equal value will be given as replacement as soon as one becomes available. No other warranty either express or implied exists between the buyer and seller of this dog. A health check by buyer's veterinarian (or buyer be present at seller's vet check) must be done within 72 hours after receiving the dog to maintain validity of this warranty. All Veterinary expenses are the sole responsibility of the buyer. Buyer is also responsible for the costs associated with the vet check, shipping crate, (where applicable) and shipping costs (where applicable). Shipping within USA is approximately $350.00. This contract is agreed upon by both parties and is not subject to change for any reason. Deposits and purchase amounts are non-refundable. Buyer agrees not to place this animal in a shelter for any reason. In the event the buyer is unable to keep the animal it will be returned to seller. Full ownership transfers back to seller-and AKC papers will be transferred back to seller. The seller will then attempt to sell the dog and convey the amount of the original sale to buyer-minus vet expenses and boarding expense of $5.00 per day-unless a replacement dog has been given. Transportation costs for return of dog to seller are the sole responsibility of the buyer. Both parties agree that the point of sale origin is St. Louis, Missouri-USA.
